Terms & Conditions / Intake Form

These Repair Terms of Service apply generally to all repair services offered by LightningRepairsLLC, and all devices checked in for services: 


1. Representation & Authorization: The Client confirms that they are the owner and/or have the authority to consent to a repair of this device. LightningRepairsLLC reserves the right to refuse to provide The Client with any services for any reason, including but not limited to, if LightningRepairsLLC determines or suspects that The Client is not the owner and/or the authorized user of the device. 
The Client also confirms that any data or software that LightningRepairsLLC may come in contact with while performing services, is not confidential or proprietary to The Client or any third party.


2. Repair scope: The Client authorizes LightningRepairsLLC to perform any services that they (LightningRepairsLLC ) deem necessary for the device being checked in, including but not limited to repairs and diagnostics. The Client acknowledges that these repairs may affect changes to The Device that may be permanent and irreversible.
LightningRepairsLLC may use new, rebuilt, reconditioned or refurbished parts or components, when original parts are not available or cost effective.  
Services may include repair and diagnostics on The Device and, if applicable, the operating systems and software applications stored on The Device.
Any service that will incur a cost or fee will require The Client to agree to pay that service before it is performed. If The Client is unable to or refuses to pay after the service is provided, The Device may be held by LightningRepairsLLC until it is able to be paid for, or until abandonment occurs.
All replaced devices, parts, components, boards and equipment will become LightningRepairsLLC's property, and The Client waives all rights they may have to the replaced Device or repaired or replaced parts.


3. Manufacturer’s Warranty: Lightning Repairs LLC services are not provided as part of the original manufacturer’s warranty. If The Device is under any applicable manufacturer’s or other warranty, The Client acknowledges that LightningRepairsLLC services may void that manufacturer’s warranty.


4. Data Loss & Backups: The Client is solely responsible for backing up any software or data that is stored on their device and deleting, encrypting or otherwise protecting their data from unauthorized use. LightningRepairsLLC is not responsible for any loss, alteration or corruption of any hardware, software, data or files. The Client is responsible for any and all restoration and reconstruction of lost or altered files, data or programs. LightningRepairsLLC will not treat data on any device as confidential.


5. Technician Damage, Loss, or Theft: LightningRepairsLLC will be responsible for the physical safekeeping of checked in devices, while in their possession for service. In the unlikely event that a device is lost, stolen or damaged while it is in LightningRepairsLLC possession for service, LightningRepairsLLC will repair that device or replace it with a device of like kind and quality, which, at LightningRepairsLLC's sole discretion, may be new or refurbished.
In the event that a replacement device is provided, The Client waives all rights they may have under state or other laws to the replaced Device.
In the event that LightningRepairsLLC provides a refurbished replacement device for The Client, it will be warranted for one (1) year by LightningRepairsLLC, which will cover everything a traditional manufacturing warranty would cover. (A manufacturer warranty covers repair and replacement costs due to factory errors but excludes all damage sustained by neglect or misuse outside of that.)
In the event that LightningRepairsLLC provides a brand new replacement device for The Client, LightningRepairsLLC will not provide a warranty on the device. Instead it will be warrantied by the manufacturer of the device.


6. Abandonment: LightningRepairsLLC will contact The Client when their services have been completed and The Device is ready for pick up. The Client acknowledges and agrees that if, despite LightningRepairsLLC's efforts to contact them, The Client fails to pick up The Device or otherwise arrange for its return for more than sixty (60) days, following the completion of repairs or diagnostics, The Device will be deemed abandoned and will become LightningRepairsLLC's property, subject to all applicable provisions of law. In such an event, LightningRepairsLLC may dispose of or otherwise utilize the abandoned property in their sole discretion in accordance with applicable provisions of law, including sale of the abandoned property, proceeds of which may be used to recoup administrative and repair costs.


7. Warranty Terms: The repairs and parts used in LightningRepairsLLC's services, will be warrantied for the lifetime of the device. This applies to any full repair in which non-consumable hardware was replaced, where a brand new part was used (Examples of consumable hardware: Joysticks, and Lithium ion batteries), on a device that does not have any signs of liquid damage or corrosion.
Any completed device repair that does not meet those qualifications, will instead receive a warranty that lasts for ninety (90) days from the day of repair completion.


A. Warranty Exclusions: This Warranty does not apply to Services or repairs performed on Devices that have been exposed to moisture or liquids following the completion of LightningRepairsLLC's services. This Warranty does not provide coverage for Devices which have been subjected to abuse, misuse, damage due to external causes or an Act of God, normal wear and tear which does not affect the original manufacturer’s intended use, battery leakage or damage resulting from battery leakage. Furthermore, this Warranty does not cover defects resulting from any action by The Client, including but not limited to mishandling, physical damage, operation outside of design limits, improper repair by someone other than LightningRepairsLLC, or unauthorized modification. This Warranty does not apply if The Client's Device shows evidence of tampering or shows evidence of being damaged as a result of excessive corrosion, electrical current, heat, moisture or vibration, or as a result of improper specification, misapplication or other operating conditions outside of LightningRepairLLC's control. This Warranty covers the following software Services only: factory restores, and backups. This Warranty does not apply to Devices with software modifications performed by someone other than LightningRepairsLLC following the completion of Services, including without limitation updated software, use of unauthorized or unapproved software, viruses, malware, spyware, or attempts to modify any software that has been installed by LightningRepairsLLC. This Warranty is non-transferable and does not apply to Devices on which the serial number has been altered, defaced or is missing.


B. Warranty Procedure: If The Client's repaired or replacement Device malfunctions within the warranty term, it must be returned to a LightningRepairs store or service center for evaluation by LightningRepairsLLC, and The Client will be responsible for any applicable shipping costs. If upon LightningRepairsLLC examination, they determine at their sole discretion that the parts or repairs used in the services were defective, or in the case of a replacement Device that the replacement Device is defective, the device will be repaired or replaced at no cost to The Client.

If no LightningRepairs stores remain open & operational, then the warranty becomes void. LightningRepairs Lifetime Warranty covers any needed replacement parts & labor in the event of an error, and does not cover a refund or monetary compensation. Any potential refunds may or may not be authorized at LightningRepairs discretion.


C. Unable To Repair: In rare cases, LightningRepairsLLC may be unable to perform a complete repair on the device at all (For instance, if there are no parts that are compatible for The Device that are currently for sale on the market). In that scenario LightningRepairsLLC may offer a temporary fix with no warranty, for The Client's convenience. If the client accepts the risk of a temporary fix, then LightningRepairsLLC offers no guarantee that it will continue working long-term.
